These Terms of Service ("Terms") govern your use of the Lyph mobile application ("App") and related services provided by Lyph ("we", "our", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
You must be at least 13 years old to use Lyph. If you are between 13 and 18, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these requirements.
You may need to create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration and to update it as needed.
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period (12+ months).
Lyph grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
You agree not to:
You retain ownership of all data and content you create within the App (reflection entries, workout logs, mood check-ins, etc.). By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.
We do not claim ownership of your data. You can delete your data at any time.
Lyph includes AI-powered features (a coach, insights, and weekly/monthly reviews) that provide suggestions based on your tracked data, and that can analyze meal photos and transcribe voice input you provide. You acknowledge and agree that:
Apple Health is optional. If you choose to connect it, you authorize Lyph to read the HealthKit categories you approve (you decide which — for example steps, active energy, workouts, sleep, heart-rate summaries, height, and weight), and to write completed workouts and active-energy data if you allow it. You can revoke access at any time through your device's Settings > Privacy & Security > Health. HealthKit data is governed by both these Terms and our Privacy Policy. When Apple Health is connected, summarized metrics may be included in the context sent to our AI provider (OpenAI) to personalize your coaching and insights. We never use Apple Health data for advertising and never sell it.
Lyph is currently free to download and use, with no in-app purchases or subscriptions.
The App, including its design, code, features, logos, and branding, is owned by Lyph and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or harmful components. We do not warrant the accuracy of any data, insights, or AI-generated content provided through the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LYPH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or CAD $50, whichever is greater.
You may delete your account at any time from within the App (You tab > Settings > Delete Account). Deletion permanently removes your account and all associated data. This action cannot be undone. You may also request account deletion by emailing support@lyph.app.
You agree to indemnify, defend, and hold harmless Lyph and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.
You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
We may modify these Terms from time to time. We will notify you of material changes through the App or our website. Your continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for any disputes arising from these Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
