Terms of Service

These Terms of Service ("Terms") govern your use of the Lyph mobile application ("App") and related services provided by Lyph ("we", "our", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use Lyph. If you are between 13 and 18, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these requirements.
2. Account Registration
You may need to create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration and to update it as needed.
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period (12+ months).
3. Use of the App
Lyph grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's infrastructure or other users' access
- Use automated systems (bots, scrapers) to access the App
- Impersonate another person or entity
- Upload harmful, offensive, or illegal content
- Circumvent rate limits or abuse the AI coaching feature
4. User Content
You retain ownership of all data and content you create within the App (reflection entries, workout logs, mood check-ins, etc.). By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.
We do not claim ownership of your data. You can delete your data at any time.
5. AI Coaching
Lyph includes an AI-powered coaching feature that provides suggestions, insights, and recommendations based on your tracked data. You acknowledge and agree that:
- AI coaching is for informational and motivational purposes only
- AI responses are not a substitute for professional medical, psychological, nutritional, or fitness advice
- You should consult qualified professionals before making decisions about your health or wellbeing based on AI suggestions
- We do not guarantee the accuracy, completeness, or reliability of AI-generated content
- AI coaching has usage limits (currently 50 messages per day) which may change
- AI insights, weekly reviews, and monthly recaps are generated by third-party AI services (OpenAI) and may occasionally produce inaccurate information
6. Apple Health Integration
If you choose to connect Apple Health, you authorize Lyph to read the HealthKit data categories you approve (such as steps and active energy). You can revoke access at any time through your device's Settings > Privacy & Security > Health. HealthKit data is governed by both these Terms and our Privacy Policy. HealthKit data is never shared with third parties or used for advertising.
7. Pricing
Lyph is free to download and use. There are no in-app purchases or subscriptions.
8. Intellectual Property
The App, including its design, code, features, logos, and branding, is owned by Lyph and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or harmful components. We do not warrant the accuracy of any data, insights, or AI-generated content provided through the App.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LYPH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the App
- Any conduct or content of any third party on the App
- Unauthorized access, use, or alteration of your data
- AI coaching suggestions, insights, or recommendations
- Decisions made based on information provided by the App
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or CAD $50, whichever is greater.
11. Account Deletion
You may delete your account at any time from within the App (You tab > Settings > Delete Account). Deletion permanently removes your account and all associated data. This action cannot be undone. You may also request account deletion by emailing support@lyph.app.
12. Indemnification
You agree to indemnify, defend, and hold harmless Lyph and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.
13. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
14. Changes to These Terms
We may modify these Terms from time to time. We will notify you of material changes through the App or our website. Your continued use of the App after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for any disputes arising from these Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
